1. Acceptance of Terms

By accessing or using the Six13 Guard website (www.six13guard.com) and any related services (collectively, the “Site”), you agree to be bound by these Terms and Conditions (“Terms”) and all applicable laws and regulations. If you do not agree with any of these Terms, you must not access or use the Site.

2. Definitions

1. “Six13 Guard,” “we,” “us,” or “our” refers to Six13 Guard, Inc., a 501(c)(3) nonprofit organization providing air medical transport and related services.
2. “User,” “you,” or “your” refers to anyone accessing or using the Site or its services, including donors, flight requestors, visitors, or volunteers.
3. “Donations” refers to all contributions or payments made through the Site—whether one-time, recurring, or in exchange for flight services.
4. “Flight Request” means an individual’s submission of relevant medical or logistical information to request air transport via Six13 Guard.
5. “Content” encompasses all text, images, graphics, video, audio, code, and other materials available on or through the Site.

3. Use of the Site

1. Permitted Use: You may use the Site solely for lawful purposes and in accordance with these Terms. Prohibited activities include, but are not limited to:
   • Using the Site in any way that violates applicable federal, state, or local laws;
   • Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with any person or entity;
   • Tampering with or compromising the security or integrity of the Site, including introducing viruses or malware;
   • Attempting to gain unauthorized access to any portion of the Site or any systems or networks connected to it.
2. Intellectual Property: All Content on the Site, including trademarks, logos, service marks, text, graphics, and code, is owned by or licensed to Six13 Guard and protected by U.S. and international intellectual property laws. 4. Donations

1. Donation Processing: All Donations made through the Site are processed by third-party payment processors (e.g., credit card networks, ACH, or PayPal). By making a Donation, you agree to the payment processor’s terms and acknowledge that Six13 Guard does not store your full payment details.
2. Tax-Deductible Status: Six13 Guard is a 501(c)(3) nonprofit organization. Eligible Donations may be tax-deductible to the fullest extent permitted by law. You are responsible for confirming your individual tax status.
3. Recurring Donations & Cancellation: When you set up a recurring Donation, you authorize Six13 Guard and its payment processors to charge your designated payment method on the schedule you choose. You may cancel or modify a recurring Donation at any time by logging into your donor portal or contacting us at info@six13guard.com. Cancellation requests must be submitted at least five (5) business days before your next scheduled payment to prevent that charge.
4. Refund Policy: All Donations to Six13 Guard are final and non-refundable, except as required by applicable law or at our sole discretion. If you believe a transaction error has occurred, contact info@six13guard.com within thirty (30) days of the Donation date, providing details of the transaction.

5. Third-Party Sites and Links

The Site may contain links to third-party websites or resources that Six13 Guard does not control or endorse. We are not responsible for the accuracy, content, practices, or reliability of third-party sites. If you choose to access a linked third-party site, you do so at your own risk, and you should review the third party’s terms and privacy policies.

5. Any Donation or Flight Request transaction made through the Site;
6. Any decision to award or deny flight services.

In no event shall Six13 Guard’s total liability to you for all damages, losses, and causes of action exceed the amount actually paid by you (if any) to Six13 Guard in the twelve (12) months preceding the event giving rise to liability.

8. Indemnification

You agree to indemnify, defend, and hold harmless Six13 Guard and its officers, directors, employees, volunteers, agents, successors, and assigns from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

1. Your use of or access to the Site;
2. Your violation of these Terms;
3. Your violation of any rights of another party;
4. Any misleading, false, or inaccurate information you provide.

9. Privacy and Data Security

Your use of the Site is also governed by our Privacy Policy, which can be accessed at www.six13guard.com/privacy-polic. By using the Site, you agree to our collection, use, and sharing of your personal information as described therein. While we take commercially reasonable measures to protect your data, no method of transmission over the internet or electronic storage is completely secure; we cannot guarantee absolute security.

13. Waiver

No waiver of any breach of these Terms shall be deemed a waiver of any subsequent breach. The failure of Six13 Guard to enforce any right or provision under these Terms shall not be deemed a waiver of such right or provision.
